Introduction
Arrow run (“EVENT”) is a marine, rally type even, intended for performance offshore boats. It is NOT a race or a competition based on speed. Participants must NOT compete in any manner with other participants. The organiser encourages all participants to navigate safely with due respect to other participants and marine traffic.
Participation and boat types
Participation is allowed for performance powerboats, from 25 to 55 ft L.O.A., able to obtain a minimum speed of 40mph and a compliance with the event’s safety and insurance requirements. There is no official restriction on the type of boat, or type and number of engines.
Boat owners, captains and passengers from Greece and all over the world are accepted (provided they have valid passports and visas when necessary)
Age limit (only for captains)
You must be over [22] years of age on 1 May 2007 in order to participate in the Event as a captain. There is no age limit for passengers and team members.
Law and regulation compliance
The captain and the members of it’s team (passengers) must comply with all applicable national and international laws, regulations and marine navigation and traffic rules including without limitation, all speed regulations, navigation rules, port rules, laws relating to the safety of your boat and the passengers inside the boat, and laws relating to the possession or use of alcohol, drugs or other prohibited substances. Any disrespect on the above gives the right to the Organizer, at his sole discretion to prohibit you from participating further in the Event.
You will need to provide full insurance for your boat, and possess a valid personal skipper’s licence.
You must participate in the Event, with the Boat you stated when completing the application entry form. You will only be able to participate in another boat subject to the Organisers consent (which it is entitled to hold in its absolute discretion) and subject to the payment of an additional administration fee. The person(s) entering the Event must participate in the Event. If for whatever reason you are unable to participate your entry place is not transferable in any circumstances whatsoever.
Entry Fees (captain and team members)
All participants who have applied and are accepted, will be informed regarding the amounts of entry fees for the 2007 event. Entry fees are different for the captain and the passengers of the boat.
Captain’s entry fee covers items such us: Hotel accomodation (based on double room occupancy), Official Boat branding and identity package, Official merchandising kit, Technical support during the event, Participation memorabilia awards, Event manual and orientation kit, VIP participation in all events (during, pre, post), Beach party and bar-b-q, Gala dinner, Land and sea transfers to the hotels, Marina and moorage assistance, Personal Insurance, Official DVD copy of the event, Welcome champaign in marinas and ports, Organisation fees, VAT, and a chance in winning the big awards (This is an indicative list. The final list of inclusive items and services is a part of the official registration).
Payment Due dates
The entry fee for you (the captain) and any additional fees for additional passengers or for your support boat are due and payable within dates specified by the organizer. Failure to pay the full entry fee by the specified date will lead to either (at the Organiser's sole discretion) you being refused access to and participation in the Event and to you forfeiting such amounts of the entry fee that you have paid, or to you being liable to a late payment fee in addition to the entry fee.
Individual Support Boats
If you want to have a support boat for your mechanics, security staff and/or personal film crew accompany you on the Event (in addition to the Boat in which you are participating in the Event) an additional fee will apply. This fee will allow the support personnel access to parties on the Event and to essential travel but will not entitle the support crew to any accommodation, flights, Event merchandise or to any VIP services and/or facilities. Any support boat will have to be branded and stickered like the official participating boats as set out under articles below.
Responsibility
Captains, participants and their boats are solely responsible for any incident, damage to property or people, or accident involving themselves, their boat, or third parties anytime during the event (a waiver is to be signed, as a part of the final registration).
The organizer is taking all necessary measures to inform and to facilitate participants, during the event, but the final responsibility remains with the captains and participants.
The organizer, accepts no responsibility for the consequences of you being refused entry/exit to or from Greece and any additional costs associated with this.
All information that the Organiser requests from you in relation to your own personal details and those of your passengers and boat has to be accurate and complete.
Safety
Safety is of outmost importance during the event. The organizer will conduct a safety briefing before the event and give to all participants a copy of the event safety rules. The event safety rules will cover a wide range of rules. Special attention has to be given to safety rules related to fuel supply, overtaking in sea and marine behaviour in ports while mooring. Failure to comply at any time, will give the Organizer the right to prohibit you from participating further in the Event. You must NOT drive under the influence of alcohol or any other intoxicating substance at any time. Your boat has to be in good condition and to have all rescue and safety equipment required by the national and international laws at good and operating condition.
Conduct
You must conduct yourself appropriately at all times bearing in mind the rules of marine traffic, of the ports, as well as the hotels and other venues used during the Event. When ‘checking-in’ to all hotels a credit card must be provided as a security guarantee against any and all ‘hotel extras’ to the hotel property. Any such costs incurred must be paid for before ‘checking-out’ or such costs will be debited from the responsible individual’s credit card.
Indemnify
You will indemnify the Organiser, its directors, officers, employees and consultants against any and all claims, lawsuits and causes of action whatsoever or howsoever arising and brought against them by any third party as a result of your action or participation in the Event, including without limitation, your violation of any laws or regulations or your breach of these Terms and Conditions of Entry.
Licence
You must hold a current, valid skipper’s licence and a current and valid passport together with any relevant visa(s)
Insurance
You shall obtain and maintain appropriate insurance covering your participation in the Event and shall provide proof of such insurance in a form satisfactory to the Organiser or sign a waiver stating that you undertake all relevant responsibility. Appropriate insurance includes, without limitation, third party liability, liability cover for yourself, medical, damage to property and life insurance and also cover for your boat’s participation in the Event.
Force Majeure and cancellation
The organizer is not responsible if he cannot fulfil his obligations and the event has to be cancelled or postponed in cases of fire, earthquake, epidemic diseases announced by WHO, severely bad weather conditions, cyclone, flood, aridity, strike, lightning, war in the country, revolution, civil war, terrorist activities and similar troubles, blockade, embargo, confiscation and expropriation, as well as in other cases defined as Force Majeure by the laws and regulations.
Branding on the boats
You agree to have the "Arrow Run logo" and official Event sponsors' stickers attached to your boat (and any support boat if the Organiser so requires) during the entire Event. You are not entitled to deface, cover-up or otherwise obscure such stickers and shall endeavour to keep them clean and visible at all times. Stickers are non-permanent and easily removable without damaging boat finishes. The Organiser will therefore not be responsible for claims for damage to boat finishes as a result of the application or removal of such stickers.
Personal Sponsorship
Personal sponsorship for your boat, your support boat or your clothing is only permitted if you obtain the Organiser's prior written permission. Subject to obtaining the Organiser's written permission, you will be entitled to place your own sponsor's/sponsors' names, marks and/or logos in 2 designated positions only on your boat, your support boat and/or your clothing provided that your sponsor/sponsors does not/do not compete or conflict with the Event's official sponsors. The Organiser shall be entitled to determine the size and location of your sponsor's/sponsors' names, marks and/or logos on your boat, support boat and/or clothing. If you wish to request for personal sponsorship, you should submit a written request (to the Organiser) for permission to do so at least 90 days prior to the commencement of the Event. You shall only be entitled to place your sponsor's/sponsors' names, marks and/or logos on your boat, your support boat and/or clothing in the sizes and locations approved and permitted by the Organiser provided that your sponsor/sponsors does not/do not compete or conflict with the Event's official sponsors. The Organiser reserves the right to refuse unauthorised sponsored vehicles or individuals entry to the Event.
Unauthorised Sponsorship
If you arrive at or attempt to participate in the Event with your boat, support boat and/or clothing displaying the branding of a sponsor that has not been authorised by the Organiser, you will be required to remove such branding from your boat, support boat and/or clothing. Failing to do so, you shall be refused access to and participation in the Event (and you shall not be entitled to a refund of your entry fee).
Refunds - cancellation
A full refund (minus a 15% administration charge) will be given for cancellations until March 30, 2007.
NO refunds of the entry fee or refunds of advance payments towards taking part in the Event, will be made under any circumstances after March 30, 2007.
Refunds During Event. No show
After the commencement of the Event, the Organiser can not and will not make any refund of the entry fee or pay compensation to you if you are unable to appear in the start or continue in the Event for any reason whatsoever.
If you do not manage to complete any part of the route and are unable to stay at the provided venues, or benefit from the services included in the participation fee you will not be entitled to any refund of the entry fee whatsoever.
Footage and image Rights
By participating in the Event you consent to be photographed and to be included in the filming of footage documenting the Event. You hereby waive any and all rights of publicity or privacy and grant the Organiser full and complete permission to utilise your appearance in the Event in any and all manner and media throughout the world in perpetuity. You further agree that the Organiser has the sole discretion to use or refuse to use any photographs or footage in which you appear, and that if the Organiser does use such photographs or footage, it may be edited at the Organiser’s sole discretion. You consent to the use of your name, image, likeness, voice and biographical material about you in connection with any and all footage, publicity and related promotional material and for any and all publicity and promotional purposes. You expressly release the Organiser, its directors, officers, agents, employees, consultants, licensees and assigns from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause of action arising out of the production, distribution, broadcast or exhibition of photographs, footage or any promotional materials.
Personal Filming
You are only entitled to take photographs and film footage of your participation in the Event for non-commercial purposes (that is for personal and private use only). Specifically, you are not entitled to reproduce or use photographs or footage of the Event on any website, in any printed media or matter or in any television programme without first obtaining the prior written consent and permission of the Organiser. You hereby agree to assign (by way of present assignment of future copyright) all your right, title and interest in the worldwide copyright and all intellectual property rights in such photographs or footage in perpetuity together with exclusive worldwide rights of exploitation thereof to the Organizer.
Arrow Run Logo
Arrow Run is a registered trademark, logo and sign. You shall not be entitled to use the logo, name or sign for any purpose whatsoever (other than placing the sticker of it on your boat) without obtaining the prior written consent of the Organiser. In particular, you shall not be entitled to use the "Arrow Run" on any website or in printed materials without obtaining the Organiser's prior written consent.
Media Appearances
You shall not be entitled to arrange or conduct any media appearances relating to your participation in the Event without obtaining the prior written consent of the Organiser.
Official event providers
The organizer, is collaborating with specialized companies, selected in order to provide a value added service to all participants, at their own discretion. The company Motocraft is the official event tech support partner (for support in boat transportation and technical issues if needed), and Journeys EY ZHN is the official event travel agency (for support in creating individual pre-post holiday packages if needed).
The services of the above companies are optional. In case they are needed, the fees and all related arrangements have to be negotiated privately between the participants and these companies directly. The organizer does not have any responsibility for the final outcome nor has any kind of participation in these agreements.
Awards
The organizer will award to selected participants and/or teams awards and gift packages.
Violation of Terms
If you violate any of the above terms and conditions or refuse to follow the instructions given to you during the Event by the Organiser, you may be prohibited from further participation in the Event.
Refusal
The Organiser reserves the right to refuse participation in, or to cancel the Event at any time for any reason whatsoever (without being obliged to disclose the reason)
Change of Terms
The Organiser reserves the right to change these terms and conditions from time to time subject to notifying you of the changes. You shall be deemed to have accepted the amended terms and conditions by participating in the Event.
Greek Law
Greek law governs these terms and conditions and your participation, and you submit to the jurisdiction of the Courts of Greece.
